Terms of Use

Now & Forever is a service of CareKind LLC ("CareKind", "we", "us"). By creating an account or using Now & Forever, you agree to these terms. If you do not agree, please do not use the app.

What Now & Forever is

Now & Forever is an AI companion for remembrance, conversation, reminders and support. Companions are AI characters, not real people. Now & Forever is not a medical service and does not provide medical, legal, financial or mental health advice. Always follow the guidance of your doctor and pharmacist for medications.

Not for emergencies

Now & Forever is not an emergency service. In an emergency, call 911 or your local emergency number. Emergency contact texts are a best-effort feature and may be delayed or fail, so do not rely on them as your only safeguard. Reminders are likewise best-effort and may not always be delivered on time.

Your account

• You are responsible for keeping your login secure and for activity on your account.
• You must provide accurate information, including phone numbers you have the right to use.
• You must have permission from anyone whose contact details you add, such as an emergency contact.

Creation fee, memberships and sample time

• Creating a Loved One has a one-time creation fee, paid by the person who creates the profile. Invited family members do not pay it.
• Ongoing voice and conversation features require a membership (Remember, Connected or Forever), billed monthly or annually until cancelled. Each person pays for their own membership.
• Memberships include a monthly allowance of voice minutes that does not carry over. Additional minutes can be bought and are never charged automatically.
• Animated video uses separate credits and is not unlimited.
• People invited to a Loved One receive a limited sample of connection credits for that Loved One, once. A new invitation does not renew it. Afterwards they need their own membership to continue.
• A membership never changes who owns a Loved One or who may edit it. Only the owner can grant editing permission.
• Voice reminders remain available as a separate monthly subscription for existing subscribers.
• Payments are handled by our payment provider.

Acceptable use

• Do not misuse the app, attempt to break or overload it, or use it to harass or harm others.
• Only upload voice recordings and content you have the right to use. Do not use another person's voice without permission.
• Do not use Now & Forever for anything unlawful.

Availability and liability

Now & Forever is provided "as is". We do not guarantee it will always be available or error free. To the fullest extent permitted by law, CareKind LLC is not liable for indirect or consequential losses arising from your use of the app.
